Appendix regarding the processing of personal data by the Institute of Legal Sciences of the Polish Academy of Sciences  in the publishing process

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (a.k.a. General Data Protection Regulation, OJ of the EU 2016 No. 119 p. 1), we declare that:

  1. The administrator of your personal data (first name and surname, e-mail address, telephone number, residential address, correspondence address, and ORCID identifier) is the Institute of Legal Sciences of the Polish Academy of Sciences (hereinafter: ILS-PAS).
  2. The Data Administrator may be contacted by post (Nowy Świat 72, 00-330 Warsaw), by e-mail (iod@inp.pan.pl), and by phone (+48 22 826 75 71).
  3. Your personal data will be processed for the purpose of providing digital access to your publication in scientific journals published by ILS-PAS, in the digital institutional repository, and/or on the journal’s website, and to establish your personal copyright, especially arising from Art. 16, Item 2 and Art. 17 of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 1994 No. 24, Item 83 with amendments) based on Art. 6, Clause 1, Items a and b of the General Data Protection Regulation of 27 April 2016.
  4. Access to your personal data will be provided to authorised employees as part of their official duties and to users of the ILS-PAS digital institutional repository and/or users of the publisher’s website.
  5. Your personal data will be stored for the period of time necessary to provide the service of offering digital access to publications in ILS-PAS journals, while taking into account the regulations set out in the Office Procedure Instruction and the Itemised List of ILS-PAS Files, i.e. for a period of at least 10 years from the beginning of the next calendar year after the contract date on the contract for digital publication.
  6. In the scope of personal data processing, you have the following rights: 
  7. to access to the content of your data — by exercising this right you may know which data are being processed and how and for what purpose it is processed;
  8. to correct the data — by exercising this right, you may report to us the need to correct invalid data or to supplement the data as a result of an error in data collecting or processing;
  9. to delete data — by exercising this right, you may submit a request to delete data. If the request is justified, we will delete the data immediately. This right does not apply, however, where personal data are processed for purposes related to fulfilling the administrator’s legal obligations, or to performing a task carried out in the public interest, or under the authority of a public institution entrusted to the administrator;
  10. to limit data processing — by exercising this right, you may submit an application to limit data processing if you question the validity of the processed data. If the request is justified, ILS-PAS may only store the data. Data processing may resume after the reasons justifying the limitation of data processing have ceased to exist;
  11. to transfer data — this right only applies in cases where the data is processed on the basis of consent and in an automated manner;
  12. to object — by exercising this right, you may object to the processing of your data at any time, if it is processed on the basis of Art. 6, Clause 1, Items e or f (legitimate interest or public interest);
  13. to withdraw consent to data processing — you may exercise this right at any time without affecting the lawfulness of the processing, if the data processing was carried out on the basis of consent given before its withdrawal.
  14. Your personal data will not be processed based on automated decisions — specifically, your personal data will not be profiled.
  15. Your data will not be transferred to data recipients and will not be transferred to a third country or international organisation, except for situations arising from legal provisions or your consent to register the DOI identifier for the publication and to index or publish it in international full-text, bibliographic, or bibliometric databases.
  16. You have the right to lodge a complaint with the supervisory body if you decide that the processing of your personal data violates the provisions of the above regulations.
  17. Providing personal data is voluntary; however, a refusal to provide data will result in the lack of validity of the agreement for digital access to publications in the digital institutional ILS-PAS repository and/or on the website of the journal published by ILS-PAS.
